These Terms and Conditions (hereinafter, the "Terms") govern the access and use of the quendalor.com platform (hereinafter, the "Platform"), operated by Quendalor S.R.L. (hereinafter, "Quendalor"). By accessing or using the Platform, you agree to be bound by these Terms.
1. Description of Service
Quendalor operates a collaborative real estate investment digital platform that allows users to participate in real estate development projects in the Dominican Republic. The Platform functions as a technological intermediary, facilitating the connection between investors and previously evaluated real estate opportunities. Quendalor does not guarantee specific returns nor ensure the profitability of any project. All investment carries inherent risks that the user must independently evaluate.
2. Eligibility
To use the Platform, you must: • Be at least 18 years old. • Have legal capacity to enter into binding contracts. • Provide truthful and up-to-date information during registration. • Not be subject to legal restrictions that prevent you from participating in investment activities. • Comply with applicable laws of your jurisdiction of residence.
3. Registration and User Account
By registering on the Platform, you commit to: • Providing truthful, complete, and up-to-date data. • Maintaining the confidentiality of your access credentials. • Immediately notifying Quendalor of any unauthorized use of your account. • Not creating more than one account per person. Quendalor reserves the right to verify your identity through Know Your Customer (KYC) procedures in accordance with Dominican anti-money laundering regulations.
4. Participation in Projects
Participation in real estate projects through the Platform is subject to: • The availability of the project and the minimum amounts established. • Acceptance of the specific conditions of each project, including deadlines, objectives, and distribution of results. • Compliance with applicable regulatory requirements. Each project has its own risk characteristics. Quendalor provides detailed information about each opportunity but does not offer personalized financial advice.
5. Investment Risks
By using the Platform, you acknowledge and accept that: • All real estate investment carries risks, including the possibility of partial or total loss of invested capital. • Past returns do not guarantee future results. • Project timelines may vary from initial estimates. • External factors such as regulatory changes, economic conditions, or unforeseen events may affect results. • Quendalor is not responsible for the individual investment decisions of each user.
6. Intellectual Property
All content on the Platform, including but not limited to texts, graphics, logos, images, software, and design, are the property of Quendalor S.R.L. or its licensors and are protected by the intellectual property laws of the Dominican Republic and international treaties. Reproduction, distribution, modification, or commercial use of any content without prior written authorization is not permitted.
7. Limitation of Liability
Quendalor provides the Platform "as is" and "as available". To the maximum extent permitted by law: • We do not guarantee that the Platform will function uninterrupted or error-free. • We shall not be liable for indirect, incidental, consequential, or punitive damages. • Our total liability shall not exceed the amount of fees paid by the user in the 12 months prior to the event giving rise to the claim.
8. Dispute Resolution
Any controversy arising from these Terms or the use of the Platform shall be resolved: • In the first instance, through direct negotiation between the parties for a period of 30 days. • If no agreement is reached, through arbitration administered by the Alternative Dispute Resolution Center (CRC) of the Chamber of Commerce and Production of Santo Domingo. • The arbitration shall take place in Santo Domingo, Dominican Republic, in Spanish. • The applicable legislation shall be that of the Dominican Republic.
9. Modifications
Quendalor reserves the right to modify these Terms at any time. Modifications will take effect from their publication on the Platform. Continued use of the Platform after the publication of changes constitutes your acceptance of the modified Terms. For substantial changes, we will notify you at least 15 days in advance through the Platform or by email.
